PUBLIC OFFER
For the Apartment Lease for Residential Purposes

The text of this Offer is an official public offering to individuals to conclude an Apartment Lease Agreement (the Agreement) with Casuarina Shores Co.,Ltd. (the Company) in accordance with the legislation of Thailand. The Agreement shall be deemed concluded pursuant to the terms of the Offer without exceptions and limitations from the date when the Tenant’s order (the Order) status on the Company website www.casuarinashores.info (the Website) has changed to “Reserved”, so confirmed by the Company and shall remain in force until the parties have fully completed their obligations. Text of the Offer, Tariffs and the Company’s Rules (the Rules) are available on the Company Website.

  1. Subject Matter of the Agreement
    1. The Company lease the Apartment to an individual (the Tenant) at the Casuarina Shores residence located 20 Moo 2, Cherngtalay, Thalang, Phuket, 83110, Thailand for residential purposes of the Tenant and up to 5 his/her guests with full responsibility of the Tenant for them with regard to performance of the Agreement.
  2. Apartment Lease Procedure for the Tenant
    1. Read and agree to the terms and conditions of the Offer, Tariffs, and the House Rules.
    2. Arrange and confirm the Order on the Website.
    3. To confirm booking 12,000 THB or 50% of rent is to be paid by credit card, bank transfer or cash.
    4. 50% of rent is to be paid within 60 days before check in.
    5. 100% of rent is to be paid within 1 day after check in.
    6. 3% of credit card surcharge is to be paid except payments within the order date or 30 days before check in.
    7. No surcharge for PayPal payments. 
    8. Booking deposit and rent are non refundable.
    9. Refundable Security Deposit is to be paid:
      • Short term tenants (<28 days) are required to show credit card on check in and every 2 weeks of stay to let us block 5,000 THB for 2 weeks only.
      • Long term tenants <3 months – 10,000 THB per month on check in.
      • Long term tenants 3+ months - according to rental agreement.
    10. Download Voucher confirming the Order status, the Tenant and other guests’ names, period of stay, the remaining amount of rent and other conditions, if any.
    11. On arrival, the Tenant shall receive the keys at Casuarina Shores office (the Office) or at the Security if the Office is closed.
    12. The Tenant must immediately pay to the Office for any additional services not specified in the Tariffs.
  3. Damage or Loss of the Apartment Property
    1. In case of any damage to the Apartment, loss or damage of the property therein which have occurred due to the action or omission of the Tenant, the Tenant must immediately pay the cost of repair of the Apartment, repair or purchase of new property declared by the Company, or compensate for the loss of value of the property at the discretion of the Company.
  4. Improvements
    1. The Tenant has the right to make improvements to the Apartment when the following conditions are met:
      1. The Tenant shall have the right to make improvements to the Apartment that cannot be separated from the Apartment without causing any damage to it only after receiving the written permission of the Company. Such improvements shall immediately become the property of the Company without reimbursement of expenses to the Tenant.
      2. The Tenant has the right to make improvements to the Apartment that can be separated from the Apartment without causing damage to it (e.g., rearrangement or installation of new or additional furniture or separate equipment) without permission. Before moving out from the Apartment the Tenant shall take his/her property away and fully restore the original appearance of the Apartment (e.g., placement of furniture).
      3. The Tenant shall immediately pay the cost of the original appearance restoration after uncoordinated or poorly made improvements declared by the Company.
  5. Force Majeure
    1. Force Majeure (vis major, i.e., extraordinary and unavoidable circumstances under the given conditions) are the events which led to inability to use the Apartment by the Tenant and were not caused by the Company or the Tenant, such as war, strikes, actions and decisions of public authorities, and natural disasters.
    2. The Company and the Tenant shall be released from liability for total or partial failure to fulfil their obligations under the Agreement due to Force Majeure and shall not compensate for the loss to each other or return the previously paid amounts.
  6. House Rules
    1. The Tenant shall strictly abide by the House Rules, the accepted norms of behaviour and the legislation of Thailand.
    2. In case of violation of the House Rules by the Tenant or his/her guests, the Company has the right to terminate the Agreement and evict the Tenant from the Apartment without refund of the Rent or compensation for losses.
  7. Sublease
    1. The Tenant has no rights to sublease the Apartment to others or lodge the people not specified in the Voucher.
  8. Inspection
    1. Representatives of the Company have the right to access the Apartment at any time for inspection, emergency repairs, installation of new equipment or furniture.
  9. Violation of the Agreement by the Tenant
    1. In case of violation of the Agreement by the Tenant, the Company has the right to terminate it at any time without return of the Rent and the Deposit.
  10. Violation of the Agreement by the Company
    1. In case of violation of the Agreement by the Company, the Tenant has the right to terminate it and get back part of the Rent for the unused period after all deductions according to the Agreement and the Voucher.
    2. Damage to equipment and property of the Apartment shall be repaired by the Company within a reasonable time, but shall not be deemed a violation of the Agreement.
    3. Failure to meet expectations or views of the Tenant as to the Apartment and the equipment or property contained therein, as well as the quality of service shall not be deemed a violation of the Agreement.
  11. Termination of the Agreement by the Tenant
    1. The Tenant has the right to refuse to lease the Apartment unilaterally, and without assigning any reason, which involves immediate cessation of all duties of the Company, including the return of the Rent and Deposit.
    2. In case of no-show, rescheduling of the period of stay, or premature check out by the Tenant for any reason other than violation of the Agreement by the Company, the Rent for the unused period shall not be refunded and may be deducted from the Deposit, credit card or any other the Tenant’s assets.
  12. Termination of the Agreement by the Company
    1. The Company has the right to terminate the Agreement unilaterally at any time and without assigning any reason with immediate return of the rent for the unused period of stay, if the termination of the Agreement is not caused by the Tenant’s violation.
  13. Moving to the another Apartment
    1. The Company has the right to move the Tenant to another Casuarina Shores apartment without any compensation and change of the other provisions of the Agreement.
  14. Change of the Agreement
    1. The Company has the right to change the terms of the Offer by posting its new version on the Website, but the changes shall take effect for new orders only.
  15. Payment
    1. The Company has the right to use third parties to receive the Deposit, Rent or other payments under the Agreement.
    2. In case of payment by credit card via internet, the Company has the right to verify the payment, contact the Tenant for resolution of any issues raised, and, if the Tenant is not available or if the issue remains unresolved, cancel the Order with returning the paid money.
    3. The Tenant must pay 10,000 THB of penalty for every day of delay of any payment according to the Agreement.
  16. Website
    1. The Company has the right to disable and enable services on the Website, carry out preventive maintenance on the server and other equipment used for the provision of services, informing about this on the Website if that available.
  17. Data Confidentiality
    1. The Company can guarantee confidentiality of the data provided by the Tenant.
    2. The Tenant is responsible for maintaining confidentiality of his/her username (login) and password and for all activities that occur under that username (login) and password. The Company shall not be responsible for and shall not cover the damages caused by unauthorized use of the Tenant’s login and password by third parties.
  18. Liability and Dispute Resolution
    1. The Tenant represents the interests of all his/her guests and responsible for their correct data and their fulfilment of the Agreement.
    2. The Company cannot be responsible for:
      1. Any failure or improper performance of services on his/her part or on the part of third parties caused by the violations of the Agreement by the Tenant or his/her guests, unreliability, lack, or untimely submission of the provided information.
      2. The loss of valuables of the Tenant or his/her guests.
      3. Any accidents or sickness of the Tenant or his/her guest.
    3. On the issues not stipulated by the Agreement, the Company and the Tenant shall be governed by the legislation of Thailand.
    4. The Company and the Tenant shall endeavour to reach mutual consent on controversial issues through negotiations. Otherwise the disputes raised shall be referred to the judicial authorities of Thailand.
